Wilmington Girl's School Bus Urine Cup Lawsuit Moved to Will County

A lawsuit filed by a Wilmington couple claiming their daughter was refused a bathroom break and had to urinate in a cup was moved from Cook County down to Will.

A Wilmington couple claiming their daughter was forced to urinate in a cup on a school bus during a field trip will fight their court battle in Will County.

The couple, Todd and Lisa Holmes, filed their lawsuit in Cook County Court but attorneys for Wilmington School District, Wilmington Middle School, Superintendent Jay Plese, teachers and others succeeded in having the case transferred.

The lawsuit said Todd and Lisa Holmes' daughter, identified only as "Jane Doe," was a Wilmington Middle School student when she went on a January 2012 field trip to a Chicago Wolves hockey game.

The daughter needed to relieve herself while on the school bus, the lawsuit said, but instead of pulling over so she could use a restroom, Wilmington Middle School teachers Brenna Noffisnger and Colleen Walsh "made (the girl) urinate in a cup on the front steps of the bus while the bus was moving on the roadway."

"After having been made to urinate in a cup on the front steps of the bus, defendants made Jane Doe remain on the front step stairwell while the bus continued to operate/move along the roadway," the lawsuit said.

The bus later stopped so the girl "could disembark the bus and throw out the cup of urine," the suit said.

The defendants were "extreme and outrageous," the suit said, and the girl suffered "severe humiliation, embarrassment, severe and extreme emotional distress, and other suffering."
