Man Faces Gun-Related Felony Charge After Frankfort Township Arrest

Timothy Cleary is also charged with violating an order of protection.

A Mokena man was arrested for allegedly violating a protection order and carrying a gun and ammunition without proper identification on Oct. 13 in Frankfort Township.

Timothy Cleary, 51, of the 9200 block of W. Magnolia Avenue in Mokena, faces charges for aggravated unlawful use of a weapon, a criminal felony. He is also charged with possession of a firearm with a revoked Firearm Owner’s Identification (FOID) card, possession of ammunition without a FOID card and violation of an order of protection.

According to the Will County Sheriff’s Office, a county deputy on patrol in Arbury Hills saw Cleary’s vehicle at 4:15 p.m at the intersection of Magnolia Avenue and Sycamore Street. The deputy ran a plate inquiry on the vehicle and found that Cleary had an order of protection registered against him from March 2012, and that Cleary’s vehicle was near the protected address.

The deputy spoke with Cleary, asking if he was in possession of weapons or contraband. Cleary allegedly admitted to having ammunition and a .38 caliber pistol, even though his FOID card was revoked.

According to the sheriff’s office, Cleary also had a second order of protection registered against him from April 2012. The second order stated that Cleary was not to be in possession of firearms.

Cleary was taken into custody and charged. His bail is set at $20,000, with 10 percent to apply, or $2,000. He is currently in custody at the Will County Adult Detention Facility. His court date is Nov. 5.
