Frankfort Township Supervisor Jim Moustis' Grandson Misses Court on Plea Day

The judge gave Jim Moustis' grandson a second chance to show up for his court date but said he better not be late.

Frankfort Township Supervisor Jim Moustis' grandson missed court on the day he was supposed to cop a guilty plea in a theft case but the judge gave him a second chance to show up.

"At exactly 10 o'clock on the 17th I will call his name," said Will County Judge Robert Livas, telling how grandson Nicholas Moustis better be there when he does.

"I don't care if he walks up two minutes after 10 o'clock," Livas warned.

Nicholas Moustis, 23, allegedly stole more than $3,600 from his employer, a Mokena wholesale cigarette distributor. The criminal complaint against Nicholas Moustis identified the victim of the theft as Mazher Khan.

Khan, incidentally, was sentenced in July to six months home confinement and ordered to pay $58,150 in restitution to the Illinois Department of Revenue for contraband cigarette trafficking.

After waiting until nearly 12:30 p.m. for Nicholas Moustis to appear for his 9:30 a.m. hearing, Judge Livas asked defense attorney Todd Lenzie if he knew where his client was.

"Judge, that's a good question," said Lenzie before asking for the Dec. 17 date.

Special prosecutor Dave Neal, who was appointed to the case due to Jim Moustis' position not only with Frankfort Township but also on the Will County Board, declined to request a warrant for Nicholas Moustis' arrest. Neal explained that he himself was unable to attend the last scheduled hearing because of a conflict with a case in another county.
